KURS ODBYWAĆ SIĘ BĘDZIE W FORMIE ZDALNEJ.

 

Cele kursu:
-    Making participants acquainted with the relevant legislative and soft law instruments, as well as case law and emerging doctrine in the field of business and human rights;
-    Training participants to identify and assess potential and actual human rights and environmental impacts caused by or linked to business activity;
-    Training participants to identify and characterize the types, scope and rationale for human rights obligation of business;
-    Discussing the required national authorities’ action and policies to meet the regulatory needs.

Tematyka kursu:
1.    Business and Human Rights (BHR) and its distinct character from Corporate Social Responsibility (CSR) - From voluntarism to binding rules.
2.    Corporate infringements on Human Rights: the distinction between violations (direct and indirect/complicity) and adverse impacts.
3.    The relationship of Business to Human Rights: duty bearers, rights-holders or both?
4.    The UN Guiding Principles on Business and Human Rights. The UN ”Protect, Respect and Remedy” Framework, its interpretation and implementation under national and transnational (EU) law
5.    From corporate due diligence to corporate human rights due diligence (HRDD) - clarifying and contextualizing the concept, including its substantive and procedural dimension.
6.    International legal and soft law instruments relevant for BHR (i.a. CESCR General Comment 24, OECD Guidelines, ILO instruments).
7.    National and EU legislation on corporate human rights and environmental due diligence; Polish National Action Plan.
8.    Examples of national and transnational case law on corporate obligations in respect of human rights and environmental protection (e.g. Fraport, BVerfG 128, 226; Milieudefensie et al. v. Royal Dutch Shell plc.; Notre Affaire à Tous and Others v Total SE, etc.).  
9.    Defining corporate human rights due diligence obligations in the context of a conflict of interests - the principle of proportionality and the balancing of interests as main instruments applied by courts.
10.    Operationalizing human rights due diligence at the corporate level - possible procedural steps for identifying, assessing and addressing human rights and environmental risks and/ or adverse impacts throughout corporate structures and processes
11.    Heightened human rights due diligence responsibility in the context of armed conflict; the role of value chain monitoring.


Efekty uczenia się:
-    Knows legislative, soft law and other authoritative instruments pertaining to business and human rights, as well as the relevant case law in the field;
-    Identifies possible tensions between corporate interests and interests of individuals and knows how such tensions may be resolved through balancing (weighting) of such conflicting interests;
-    Identifies and evaluates potential and actual human rights and environmental impacts caused by or linked to business activity;
-    Characterizes the types, scope and rationale for human rights obligation of business;
-    Understands the role of other state and non-state duty-bearers for the effective protection and implementation of human rights.

Informacje o egzaminie

Informacja: Egzamin nie jest obowiązkowy - jest przeznaczony dla słuchaczy, którzy chcą otrzymać Świadectwo Ukończenia Kursu. Warunkiem podejścia do egzaminu jest uczestniczenie w co najmniej 60% zajęć (12h) oraz terminowe dokonanie płatności za egzamin.
